At Tru Optik, we value transparency and choice. We want to be as transparent as possible about the circumstances in which data about you might be collected and shared. We also want to give you choices about whether and how data about you might be collected and shared.

Tru Optik Data Corp., together with our subsidiaries and affiliates (collectively, “Tru Optik”, “we”, “us” or “our”), provides a technology that allows advertisers to deliver targeted advertising in connection with longform professional video content delivered over the internet. This privacy policy explains how we collect, use, and disclose information on our advertising platform. Information We Collect and How We Collect It

We receive certain information about you, your household, and your devices from third-party data partners who provide us this information in order to help us build and deliver marketing segments for our customers. The information we collect and receive on our platform does not directly identify you, but it may be considered “personal data” or “personal information” under applicable privacy or data protection laws (collectively, “Personal Information”). The Personal Information that we collect and receive includes the following categories of information:

  • Identifiers, including IP addresses, cookie identifiers, device identifiers, other identifiers from similar tracking technologies, and unique identifiers that Tru Optik assigns to segments.
  • Internet or other electronic network activity information, including information about your visits to and use of our customers digital properties, the content you view, and other information about how you interact with internet websites, applications, and advertisements.
  • Inferences, including inferences about your interests, product preferences, political views.
  • Demographic information, including your gender, age, marital status, and education.

How We Use Your Information

We use the Personal Information that we receive and collect for a number of business and commercial purposes, including:

  • To provide advertising, marketing, segmentation, and analytics products and services to our customers and their service-providers, for example to help our customers deliver more relevant advertising and content across digital channels, and to help them measure the impact and effectiveness of their advertising campaigns.
  • To analyze and report on ad campaign performance, and to audit and verify transactions, including counting and verifying ad impressions, and measuring their quality and effectiveness.
  • To provide and improve our products and services, and to develop new products and services, including through internal research and technological development.
  • To conduct market and industry research.
  • To maintain the quality, safety, and security of our services.
  • To investigate and deter fraudulent, unauthorized, or illegal activity.
  • To market and promote our products and services.

How and Why We Share Your Information

We share Personal Information with third parties as follows:

  • Our customers. We share Personal Information with our customers in order to help them with their advertising campaigns, among other purposes. For example, customers may use the Personal Information to provide you targeted advertising and to help them evaluate whether a particular ad campaign may be of interest to you. Our customers may use this information in conjunction with other information they have independently collected.
  • Our vendors, partners and other service providers. We may share Personal Information with our vendors and partners that perform functions on our or our customers’ behalf, that assist us in providing our services or products or otherwise responding to your requests, and that provided us with other services. Examples may include: analyzing data, helping us to improve our platform, products, and services, and helping us develop new products and services.
  • Market and industry research partners. We may share Personal Information with third parties for market and industry research purposes.
  • Tru Optik subsidiaries and affiliates. We share Personal Information with our wholly owned and controlled affiliates and subsidiaries for use for any of the purposes described in this Privacy Policy.
  • Business transfers. We may share user information in connection with a proposed or consummated sale or transfer of all or a part of our business or assets, corporate merger, consolidation, or bankruptcy.
  • Where required to protect vital interests, enforce legal rights and comply with laws. We may share Personal Information with law enforcement, regulatory authorities, courts, emergency services or other necessary third parties for legal, protection, security, and safety purposes, when we believe in good faith that disclosing this information is otherwise necessary or advisable. Examples include:
    • to comply with laws or regulatory requirements and to respond to lawful requests and legal process;
    • to protect the rights and property of Tru Optik, our agents, customers, and others, including enforcing our agreements, policies, and Terms of Use and protecting our network and physical assets; and
    • to protect the safety of our employees and agents, our customers, or any other person.

Opting Out of Targeted Marketing Using Tru Optik Market Segments

Tru Optik identifies “households” for purposes of delivering targeted advertising based on behavioral/interest-based categories and other information associated with such households. One of the elements (but not the only element) that make up a "household" is the IP address associated with that household. IP addresses are assigned by your Internet service provider to the modem used to access the internet for connected devices in your home and/or business. When you choose to opt out through privacy.tv, we will exclude any "households" in our market segmentation data products that are associated with the IP address(s) from which you have chosen to opt out. For this reason, you should opt out at each location where you wish to not receive targeted OTT advertising that is based on Tru Optik-delivered market segments. In the event your IP address changes, or you access an OTT service from a different location, the opt out will not be effective.

You can also click below to opt out of having Tru Optik data used to select ads for your browser and/or non-browser-enabled software clients based on your online web browsing behavior. When you opt out, an opt-out cookie (from dmp.truoptik.com) will be stored in your web browser, and your IP address will also be stored by Tru Optik. Tru Optik will know the choice you have made when it sees your optout cookie, or, with respect to non-browser-enabled software clients, your IP address, and will apply your choice to all companies’ use of Tru Optik audience segments. If you block or delete the opt-out cookie, Tru Optik will not see your choice.

OPT-OUT

When you opt out, we will set a cookie that tells us not to select ads using your browsing behavior. If you delete your cookies, you will need to opt out again. The opt out only applies to the browser in which you set it. If you opt out, data may still be collected about your web browsing activities and you will still see advertising. If you wish to block or delete cookies altogether, you can use web browser settings to do so. We will store your opt out choice with your IP address, but the choice will not be effective if your IP address changes or if you use an OTT service from another location.

Data Retention

We store and retain data, including Personal Information, in non-aggregated form for up to 18 months from the date of collection. We use aggregated data for reporting and analysis and may store it for up to 2 additional years from the date of collection.

Information we Collect, Use, and Disclose

California law requires us to disclose the categories of Personal Information we collect and how we use them, the categories of sources from which we collect Personal Information, and the third parties with whom we share Personal Information. We have provided this information above in the “Information We Collect and How We Collect It,” and “How and Why We Share Your Information” sections of this Privacy Policy.

In the past 12 months, we have sold and disclosed for commercial and business purposes the following types of Personal Information with third parties:

  • Identifiers;
  • Internet or other electronic network activity information; and
  • Demographic information.

Do Not Sell My Personal Information

Some of our disclosures of Personal Information to third parties for business or commercial purposes may constitute “sales” under California law. You may opt out of these sales by following the instructions under “Opting Out of Targeted Marketing Using Tru Optik Market Segments” above. When you exercise your right to opt out, we will no longer share your Personal Information in a way that constitutes a “sale” under California law.

Access and Deletion

If you are a California resident, you also have the following rights:

  • Make an access request, including requesting a copy of the specific pieces of Personal Information we have collected about you, along with other information about our information collection and sharing practices;
  • Request deletion of your Personal Information.

Please note that because most of the information we store can only identify a particular device or browser, and does not identify you individually, you may need to provide us with some additional information to enable us to identify you and the Personal Information about you, if any, and ensure that we accurately fulfill your request. We will never discriminate against you for exercising any of your rights under California law.

Children

Tru Optik does not intentionally collect Personal Information from children under 16, and never sells the Personal Information of any individual that that it knows is under 16. Information Our Customers Collect through the Tru Optik Data Management Platform ("DMP")

Our technology platform, the Tru Optik DMP, enables our clients to deliver more relevant advertising and content to consumers across digital channels, including desktop, mobile, and connected TV, by gathering data about your visits to, and use of, their digital properties. The Tru Optik DMP is licensed to our customers for their own purposes, and we do not control how they use or share the data that they collect. These customers have their own policies that govern how they collect, use, and share data, which may differ from Tru Optik’s own data collection, usage, and sharing policies. Please consult the privacy policies of the websites you visit and apps you use to become familiar with their privacy practices.
